Boccia ProTrainer Terms of Service

§ 1. Definitions

• Provider — [Jarosław Plewa / Business Name], Tax ID (NIP): [XXX], address [full address]
• Service — website and web application at bocciaprotrainer.com (marketing site) and app.bocciaprotrainer.com (application)
• User — natural person or legal entity using the Service
• Consumer — natural person performing a legal act not directly related to their business or professional activity (EU Consumer Rights Directive)
• Subscription — paid recurring service in one of the plans: Starter, Pro, Elite, Coach 8, Coach 15
• Trial Period — 14 days of free access to the Pro or Elite plan (no card required) / 7 days of free access to the Coach plan (with card)
• Founders Lifetime Deal — one-time, limited offer of lifetime access (50 Pro seats / 20 Elite seats)
• Lemon Squeezy — payment processor and Merchant of Record handling all transactions in the Service

§ 2. Technical requirements

• Modern web browser: Chrome, Edge, Safari or Firefox (last two versions)
• Stable internet connection
• Active email address
• Cookies and JavaScript enabled

§ 3. Registration and account

1. Account registration requires a valid email address and password (minimum 8 characters).
2. The User warrants that the provided data is true and current.
3. The account is personal — sharing it with third parties is prohibited.
4. The User may delete the account at any time via Settings → Delete account.

§ 4. Plans and billing

4.1 Available subscription plans

Prices in Poland are listed in PLN and include 23% VAT (calculated by Lemon Squeezy as Merchant of Record). Global prices are listed in USD; local taxes (EU VAT, US sales tax, etc.) are added automatically based on the billing address.

4.2 Founders Lifetime Deal

Limited-time offer — Pro lifetime for 549 PLN / $159 (50 seats) and Elite lifetime for 1099 PLN / $329 (20 seats). Once seats are sold out, the offer ends. Limit is enforced through a seat-reservation system on the Provider's side.

4.3 Payment processing

1. Payments are processed by Lemon Squeezy — the Provider does not store card data.
2. Lemon Squeezy acts as Merchant of Record and is responsible for VAT/tax compliance under the rules applicable in the User's country.
3. Subscriptions renew automatically until cancelled.
4. A VAT invoice is sent by email directly from Lemon Squeezy after each billing period.

4.4 Trial Period

• Pro / Elite plans: 14 days of free access without card details required. After the trial ends, the account moves to a suspended (read-only) state unless the User activates the subscription.
• Coach 8 / Coach 15 plans: 7 days of free access with card details required. After 7 days the User is automatically charged unless cancelled before the deadline.

§ 5. Cancellation and refunds

1. EU Consumers have the right to withdraw from the contract within 14 days without cause (Art. 27 of the Consumer Rights Directive), unless the Consumer explicitly requested immediate service delivery before the deadline and accepted the loss of the right of withdrawal (Art. 38(13)).
2. When purchasing a Subscription with immediate access to digital content — the Consumer is informed at checkout about the loss of withdrawal rights after service starts.
3. To exercise the right of withdrawal, send a notice to support@bocciaprotrainer.com with the order number.
4. Refunds are issued within 14 days of receiving the notice, to the same payment method.
5. Cancellation during a monthly/annual billing cycle: access remains until the end of the paid period; no pro-rata refund is provided.
6. Founders Lifetime Deal: Consumers retain the 14-day right of withdrawal with full refund. After this period, access is lifetime and non-refundable.

§ 6. Acceptable use

The following is prohibited:

• ❌ Infringement of copyright, trademarks, or other intellectual property rights of the Provider or third parties
• ❌ Attempts to gain unauthorized access (hacking, scraping, reverse engineering)
• ❌ Reselling app content or data without the Provider's written consent
• ❌ Using the account for illegal purposes
• ❌ Disrupting Service operation (DDoS, spam, high-frequency scraping)
• ❌ Sharing login credentials with third parties

Violation results in immediate account suspension without refund.

§ 7. Liability

1. The Provider strives to keep the Service running continuously (target SLA: 99.5% monthly uptime), but is not liable for:
   • Outages caused by force majeure, internet infrastructure failures, or processor outages (Supabase, Lemon Squeezy, Vercel)
   • Data loss caused by User actions (e.g., account deletion)
   • Sport, health, or training outcomes resulting from recommendations or plans generated by the app — the app does not replace a coach or a physician
   • Financial decisions made based on information in the app

1. The Provider's maximum liability for contract performance is capped at the fees paid by the User in the last 12 months.

1. These limitations do not exclude or limit the Provider's liability for gross negligence or willful misconduct.

§ 8. Intellectual property

1. All content, source code, graphics, knowledge bases (drills, training plans, BISFed terminology), and trademarks in the Service belong to the Provider or are used under appropriate licenses.
2. The User receives a non-exclusive, non-transferable license to use the Service for the duration of the Subscription, solely for personal use (or club use in the case of Coach plans).
3. Data entered by the User (shots, plans, notes, wellness data) remains the User's property. The Provider receives a technical license to process it solely for service delivery.

§ 9. Complaints

1. Complaints should be submitted to: support@bocciaprotrainer.com.
2. The complaint should include: User's contact details, order/account number, problem description, and the expected resolution.
3. The Provider responds to complaints within 14 days of receipt.

EU Consumers may also contact their local consumer protection authority.

§ 11. Final provisions

1. Governing law: Polish law.
2. Jurisdiction:
   • For disputes with Consumers — court of the Consumer's place of residence
   • For disputes with Businesses — court of the Provider's registered office
3. Changes to these Terms: material changes are announced via email at least 14 days in advance. Lack of acceptance entitles the User to terminate the contract immediately.
4. Matters not covered by these Terms are governed by the Polish Civil Code, the Consumer Rights Act, and the GDPR.
